About the Circuit Court Clerk’s Office
The Circuit Court Clerk is charged with more than 800 statutory responsibilities that fall into one of the following three areas:
Judicial
Act as Custodian of Court’s records
- Manages filings, pleadings and other case records lodged with the Court and Clerk’s Office.
- Ensures members of the judiciary are provided case-related information needed to conduct court proceedings.
- Criminal cases
- provides assistance to
- law enforcement
- corrections officials
- prosecutors
- defense counsel
- defendants
- general public
- issue arrest documents/legal process to be served on
- defendants
- witnesses
- provides assistance to
- Lends overall judicial support by
- maintaining and disposing of civil and criminal evidence
- receipting criminal fines and court costs
- collecting and disbursing restitution on behalf of crime victims
- investing and distributing monies on behalf of civil litigants or third-party beneficiaries
- Providing statistical data, case-related information and court documents to
- state, local and federal agencies
- citizens

Inquiries concerning existing policies, procedures and records access should be directed to the Clerk's Office, which serves as the clearinghouse for court rulings and general case information.
Non-judicial
Serves as
- Probate Judge
- Admits or denies wills probate
- Qualifies executors, administrators, guardians, and/or conservators
- Register of Deeds
- Maintains all land records
- Records deeds, deeds of trust, real estate liens and releases, and other documents Other transactions and recordings processed include
- judgments
- financing statements
- fictitious names for businesses
- marriage licenses
- concealed handgun permits
- variety of oaths and/or appointments including
- ministers
- notaries
- local Commission members
- Board members
- law enforcement officers
Other duties
- Required by statute to permanently preserve and archive the official records of the Court, in addition to probate (estate), real estate, and a vast array of other county records
- Maintains records dating back to 1749, the year of the county's inception
Fiscal
Fiscal responsibilities of the Clerk's Office include
- the maintenance and investment of trust, equity, and condemnation funds
- the collection of
- court fines/costs
- restitution
- civil filing fees
- real estate transfer fees
- recordation taxes
- other fees authorized by statute
The Clerk's Office annually generates millions of dollars in revenue for both the state and county. Such monies are used to fund citizen services of all types, while fines and costs collected in criminal cases produce a significant revenue stream for funding the prosecution and incarceration of criminal defendants.

Note
Recording hours are subject to change in the event of inclement weather or holiday closings. Filing parties are encouraged to call the Clerk's Office in advance to ascertain any deviation from normal recording hours.
Filings
The Court does not accept case-related filings via the internet, email or fax. Filings are accepted via mail, courier or hand delivery.
Location
The Circuit Court Clerk's Office is on the first floor of the Courts Building located at the intersection of Ironbridge Road (Route 10) and Courthouse Road. The Courthouse is a large brick building with white columns and a circular drive.
Parking
Parking is permitted in any area except those that are gated, marked "reserved," or designated for jurors. There is no fee for parking.
