Funds Held by the Court
Fund Administration
The Circuit Court handles fund administration in relation to trust funds, equity funds and condemnation funds.
Note that, for all funds administration, any tax consequences are the responsibility of the beneficiary.
Trust Fund Administration
When the Clerk is to invest funds for the benefit of a minor, the court order should specifically direct the Clerk to invest such funds pursuant to Code of Virginia § 8.01-600.
- Orders that include social security numbers will not be processed.
- Orders should include wording which reflects that funds are to be held until the infant reaches the age of majority.
- An affidavit must be presented that includes the beneficiary’s name, date of birth, address and social security number.
To Claim Trust Funds
Since trust funds are invested through an off-site financial institution, advanced notice of the intent to claim funds is required.
When the infant reaches the age of 18, they should contact the Circuit Court Clerk’s Office regarding procedures to collect trust funds.
- Parties claiming funds are required to present a photo ID (preferably a driver’s license) and a copy of their birth certificate.
- Parties who are unable to appear in the Clerk’s Office in person may be asked to provide additional documentation.
If the original court order directing investment of funds does not state the date on which the funds may be released, a new court order must be presented to and entered by the judge before the funds can be disbursed.
Any tax consequences are the responsibility of the beneficiary.
Equity Fund Administration
When the Court directs that funds be held in an interest-bearing account in Civil matters other than infant settlements, they are considered equity funds. Equity funds are held pending further order of the Court.

Condemnation Fund Administration
Condemnation funds are invested in interest-bearing accounts upon receipt. Such funds are disbursed only pursuant to court order.

Excess Funds Lists
Although the Clerk’s Office can provide reports which list funds held by case number, such reports do not identify the specific source of the funds, nor do they include contact information for the payees. All such information would presumably be contained within the individual case files. Remote access to case files is unavailable to the general public. Files are available for review during the Record Room public service hours (8 a.m.- 4 p.m., Monday through Friday (excluding holidays)).
Pursuant to Virginia law, copies of the excess funds lists can be requested at a rate of $.50 per page; monthly reports are typically two pages ($1 copy fee total) and list all funds currently held by the Court/Clerk.
- If paying by credit card over the phone, call the Record Room at 804-717-6517. Phone requests are payable by Visa or MasterCard (for an additional $2 processing fee plus postage).

Foreclosure Lists
No master list of pending private auctions/foreclosures is available through Chesterfield County. Private auction/foreclosure information is often printed in local publications that print legal notices.
Free access to indexes of land records is available online. If you locate records of interest in the index, official land records are available for review in the Circuit Court Clerk's Record Room, located on the ground floor of the main Courts Building, during public service hours (8 a.m.- 4 p.m., Monday through Friday (excluding holidays)). Pursuant to Virginia law, copies are $.50 per page.

Location
The Circuit Court Clerk's Office is on the first floor of the Courts Building located at the intersection of Ironbridge Road (Route 10) and Courthouse Road. The Courthouse is a large brick building with white columns and a circular drive.
Parking
Parking is permitted in any area except those that are gated, marked "reserved," or designated for jurors. There is no fee for parking.
